- These Terms and Conditions (“Agreement”) apply to all shipments and services provided by Kobo Freight Services Ltd (“Kobo”, “we”, “us”, or “our”). By engaging our services, the customer (“you”, “client”, or “shipper”) agrees to the following:
1. Services Provided
Kobo Freight Services offers freight forwarding, consolidation, customs clearance, and delivery services between the United Kingdom and the Democratic Republic of Congo (DRC).
2. Booking and Payment
• All bookings must be confirmed in writing – either by email, WhatsApp, signed agreement, or through our online booking system.
• Customers are also encouraged to register on our secure customer portal to track shipments, receive notifications, and access order history.
• A minimum deposit of 50% is required at the time of booking. The remaining balance must be paid in full before the shipment leaves the origin country.
• Prices are subject to change based on volume, destination, fuel surcharges, and applicable customs or regulatory fees.
3. Documentation
The customer must provide accurate and complete shipping documentation, including but not limited to invoices, packing lists, and identification documents. Kobo is not liable for any delays, penalties, or losses caused by incorrect, missing, or fraudulent documentation.
4. Prohibited and Restricted Items
• It is the customer’s responsibility to ensure all shipped items comply with the import and export regulations of both the origin and destination countries.
• Prohibited items include but are not limited to: firearms, illegal drugs or substances, counterfeit goods, flammable materials, or perishable food (unless previously agreed in writing).
• Kobo reserves the right to refuse any item deemed unsafe, illegal, or non-compliant.
5. Insurance and Liability
• Shipments are not automatically insured. Insurance must be explicitly requested in writing, and the customer must pay the applicable insurance premium in advance.
• Kobo is not liable for loss, theft, damage, or delay, unless resulting from gross negligence or misconduct on our part.
• In all cases, Kobo’s liability is limited to £100 or the amount paid for the shipment, whichever is lower, unless covered by separate insurance.
6. Delivery and Collection
• Delivery timelines are estimates only and may vary due to customs clearance, port delays, or external circumstances beyond our control.
• Customers must collect their goods within 7 working days of receiving the arrival notification. Storage fees may apply after this period.
• Goods not collected within 30 calendar days of notification may be disposed of or sold without further notice or compensation.
7. Customs and Duties
• Kobo may assist with customs clearance procedures but does not guarantee clearance success or specific timeframes.
• All customs duties, import taxes, and clearance charges are the sole responsibility of the customer, unless otherwise agreed in writing.
8. Cancellations and Refunds
• Cancellations must be made at least 72 hours before dispatch to be eligible for a refund, subject to an administrative fee.
• No refunds will be issued once goods have been dispatched or consolidated for shipment.
9. Governing Law
This Agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise mutually agreed.
10. Acceptance
By using our services, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.
